BIMBA Y LOLA offers the products of the Website solely to end users acting for personal purposes, who acquire goods with no intentions of reselling them. By using the Website, you represent and warrant that you are acting as the final consumer of the ordered product(s).

The “end user” is any individual or legal entity that acts on this Website for purposes different from those corresponding to the commercial, business or professional activities normally undertaken.

Global-e reserves the right not to fulfil orders made by entities different from the end user. Becoming a registered user enables you to browse through the different restricted-access areas included on the Website, use the services that require you to log-in, and acquire any BIMBA Y LOLA products that may be offered on the same. Becoming a registered user requires you to read and expressly accept, without any reservations, these Conditions, acknowledging your prior awareness and allowing you to save and reproduce them.

Registration on the Website shall be approved by BIMBA Y LOLA, after verification of the information provided in the registration form. Then, users shall receive a registration confirmation mail. At the time of registration, you are obliged to submit accurate and complete information, in order to complete your user account.

The username and password generated to identify you as a user and allow you to use the service are strictly personal and confidential. You are responsible for maintaining their confidentiality. As a result, you expressly accept, unless proven otherwise, that we will assume that all usage of the service with your identification codes is done by you, as the registered user, unless you have notified us in advance that they have been lost or stolen.

You may freely change your password through the procedures that we have put in place for that purpose. The replaced password will be cancelled as a means of identification as soon as you generate the new one.

We may block access and usage when as deemed necessary, and for security reasons. The service will be blocked automatically following three successive errors in entering the user access or usage codes.

We will implement the necessary organisational and technical measures on our computer systems to ensure proper use of the service by the users, and to prevent unauthorised access that could lead to the disclosure of the user’s information content that is accessible through the service.

As a user, you are obliged to:

a) Provide BIMBA Y LOLA all necessary data to access and use the services that require prior identification. This information must be accurate, up-to-date and correct. Users are required to provide their personal details (such as first name, surname(s), postal address, e-mail address and other contact information) truthfully. If you fail to provide all the required information, we will be unable to provide the service. BIMBA Y LOLA shall not be liable under any circumstances for any delays or failures due to errors or omission in the provided data.

The BIMBA Y LOLA products offered on the Website are distributed exclusively within the territory of Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Greece, Hungary, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, Republic of Ireland, Romania, Slovak Republic, Slovenia and Sweden.

Any order with a delivery address located outside of these countries will be rejected during the request process.

The content of our Website is an invitation to purchase. Any purchase conducted from our Website will be executed between you and Global-e, as BIMBA Y LOLA’s merchant of records.

Until your order has been expressly accepted (even if your account has been charged), there is no contract between you and Global-e. If your order is not accepted and your account has been charged, the full amount will be reimbursed.

To place an order, you are required to follow the shopping process through our Website as a registered user or as a guest, where BIMBA Y LOLA products are available with the following information:

a) Description of the product, reference, size, characteristics, colors, composition and photograph.

Price and currency.

The prices on our website are shown in Euros for all countries, and other currencies that may be applicable (Bulgarian Lev, Czech koruna, Danish krone, Forint, and/or Swedish Krona), and exclude delivery charges and other applicable amounts (import and export cost, among others).

BIMBA Y LOLA reserves the right to modify the prices shown on the Website without prior notice. The price of the products will be as shown on our Website at all times, except in case of an obvious error. Although we make every effort to ensure that all listed prices are correct, errors may occur. If we discover a pricing error for a product(s) you have ordered, Global-e will cancel the order and any amount paid will be fully reimbursed. You understand that products offered by BIMBA Y LOLA on the Website are subject to stock limits. All orders for BIMBA Y LOLA products are subject to availability. If any of the products are not available once you have placed the order, Global-e will inform you as soon as possible. At that time, you can cancel your order.

BIMBA Y LOLA reserves the right to modify the products offered on the Website at anytime without prior notice.

Any request to return your order must be addressed through the return portal operated by Global-e, available here , following the instructions contained therein, and providing the requested information.

We will determine whether the BIMBA Y LOLA products are in the same condition as those in which they were sent to you. You will be liable for all losses in value of the products resulting from handling, beyond what is necessary to establish their nature, characteristics or functionality. No refund will be issued for returned products that are damaged, incomplete, spoiled, used or soiled due to customer’s fault.

As shopper, you will take ownership of the BIMBA Y LOLA products upon receiving the shipping confirmation, and once the product leaves our warehouses. The liability for the BIMBA Y LOLA products is transferred to you in accordance with Global-e’s Terms of Sale.

If you receive an erroneous order or a defective product, we ask that you to contact Global-e immediately, within 24 hours, providing the details of the error and/or defect, along with your personal data and contact details here.

Our Website offers you the option to send items as gifts. To do so you should make the purchase via your computer as usual way, selecting the gift option. By choosing this option, your order will be wrapped in a single parcel and we will send a BIMBA Y LOLA card with the personalised message you want to send to the recipient of the gift.

If you provide personal data of a third party, you guarantee that you have the authority to process such data. Likewise, you are also obliged to inform said third party about the terms and conditions for the processing of their data, according to this Conditions, our Privacy Policy and Global-e’s Privacy Policy.

For security reasons, you cannot place orders in excess of €3.000, nor containing over 30 items within 15 days.

The products offered on our Website represent a carefully selected sample of our collection. We have taken special care in showing the colours and characteristics of our products with great accuracy. Of course, each monitor is calibrated differently, and we cannot guarantee that your monitor shows entirely true colors.

None of these purchase conditions exclude or limit our liability for (1) death or personal injury caused by our negligence, (2) fraudulent statements, (3) any other liability that may not be limited or excluded under the applicable law.

Force Majeure includes any fortuitous event, act, lack of service, omission or accident that is beyond our reasonable control, especially including but not limited to the following:

- Strikes, lockouts, riots, or other forms of protest.
- Civil unrest, revolt, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war.
- Fire, explosion, storm, flooding, earthquake, sinking, epidemic or any other natural disaster.
- Inability to use trains, ships, aircrafts, motor transport or other means of transport, whether public or private.
- Inability to use public or private telecommunication systems.
- Acts, decrees, legislation, regulations or restrictions declared or imposed by any government.
- Those situations, cases and/or circumstances accepted by case law.

Our obligation to perform any duties under these Conditions will be suspended during the period in which the Force Majeure situation remains in effect. We shall be granted an extension of the period of time stipulated to fulfil our obligations while such a situation persists. We will make every effort to bring an end to the Force Majeure situation or to find a solution by any means that allows us to fulfil our obligations under these Conditions, despite the Force Majeure event.
